Florida No Fault
What does it mean that Florida is a “No Fault” State?
“No Fault” DOES NOT MEAN that if someone is at fault for a motor vehicle accident, that the injured party cannot make a claim against them. That is just not true.
“No Fault” MEANS that if YOU are hurt in an auto accident and it is not your fault, and you need medical attention, then Florida law says you must first go through your own auto insurance company’s Personal Injury Protection (PIP) benefits of $10,0000 – for the pay as you go Medical Expenses and for reimbursement of Lost Wages –
Your PIP Auto Coverage acts as the primary payor source - EVEN IF you have Health Insurance. (Your Health Insurance will then act as a secondary payor source.)
Making a Personal Injury Claim in No-Fault Accident
To make a Personal Injury Claim against the at fault party, you then look to see if they have Bodily Injury Coverage (BI) Insurance – which unfortunately IS NOT REQUIRED under Florida law.
If the at Fault Party Does Not have Bodily Injury Insurance, you can then turn to your own Auto Insurance Policy to make a claim for Uninsured Motorist (UM) benefits.
That is why it is crucial to have as much Uninsured Motorist Coverage as you can get.

Halloween - Pedestrian Safety
Pedestrian injuries are the most common injuries to children on Halloween.
Often, children are darting from house to house, crossing streets mid-block, wearing dark costumes, and are focused on candy not necessarily their safety.
We encourage motorists to:
- Watch for children in the roads, medians
- Enter and exit driveways and alleys carefully
- And at twilight and later in the evening, watch for children in dark clothing
Have a safe and happy Halloween.
