Elderly Woman Awarded Defendants Bodily Injury Insurance Coverage
Mrs. Vandoli was operating her 1997 Lincoln Towncar when the Defendant ran a stop sign and violated her right of way. The Defendant was cited, pursuant to Florida Statue 316.122, for failure to yield to Mrs. Vandoli.
The collision caused extensive front end damage to Mrs. Vandoli’s vehicle. Although she was restrained, Mrs. Vandoli’s entire body was subjected to an extremely high Delta-V change in velocity. At the time of the collision, Mrs. Vandoli’s right foot was on the brake petal and the heavy impact from this front-end collision caused her right ankle to shatter. She suffered from an ankle fracture, chronic pain and acute function decline. This caused additional hardship because Mrs. Vandoli was the sole caregiver to her husband, who required constant medical attention.
Mrs. Vandoli was taken from the crash scene by Palm Beach County Fire Rescue to Delray Community Hospital; where she stayed for several days. Orthopedic Surgeons performed surgery (an open reduction and internal fixation [ORIF]) to repair her right ankle (bimalleolar fracture). Mrs. Vandoli then spent several months recovering and undergoing extensive physical therapy in a convalescence center.
