was hit by a commercial truck driver who had no business being on the roadway.
When our client was rearended early in the morning on a long straight roadway by a driver, who evidence supported had a history of being in possession of paraphernalia when driving a commercial truck, she suffered a serious exacerbation of a prior low back injury. Despite evidence from her treating doctor and her treating worker’s compensation doctor that this crash was the cause of her need for surgery, the defense made a low-ball offer and claimed everything was pre-existing.
With that, the case was put into litigation and the pressure was applied to the defendants and their insurer. After months of litigation when the insurance company realized this case was not going to resolve for the pennies on the dollar we were able to push the case into an early global mediation. There, the insurance company again tried to avoid fairly compensating our client; however, when confronted with caselaw indicating that they were exposing themselves and their insureds to bad faith, the tune swiftly changed resulting in a fair settlement for our client with the active tortfeasors.
After the underlying case resolved, we were able to secure the entire policy limits for the Underinsured Motorist (UIM) coverage allowing for a full recovery on behalf of our client – despite its first offer being only 10% of the policy limits. We were able to quickly show that the carrier’s initial evaluations were inadequate.
