Resolved Bicycle VS. Motor Vehicle Claim for all Available Insurance Coverage of $200,000 ($100,000 Bodily Injury (BI) Coverage and $100,000 Uninsured/Underinsured (UM) Coverage)
Attorney Scott Murray and Paralegal Brenda Sheffield recently resolved a bicyclist versus motor vehicle claim for all available Bodily Injury (BI) and Uninsured/Underinsured (UM) policy limits.
This incident occurred when a driver failed to yield the right-of-way as our client was crossing a street in the crosswalk while manually pedaling his electric bicycle. He was violently thrown into the busy road, landing hard on his right side. Fearing he would be run over, he dragged himself back to the sidewalk and collapsed. At the scene, our client was in shock and disoriented. Although he declined to be transported by ambulance, his wife took him to a satellite emergency room where he complained of multiple abrasions, right buttock pain, and right hip pain. He was unable to walk on his own, so the emergency room provided him with a walker.
After returning home and trying to recover from the physical and emotional trauma of the crash, his wife found him unconscious and called 911. He was then admitted to the hospital for observation.
In the following days, our client began experiencing hand numbness and electric shock-like sensations in his arms. He presented to a board-certified neurosurgeon who recommended decompression surgery to alleviate the pressure on his spinal cord. Given our client s advanced age, he opted for less invasive treatment, although he is still considering the surgery.
The driver responsible for the crash carried $100,000 BI coverage on her policy. After preparing a detailed demand package, the at-fault driver s insurance company tendered its $100,000 limits. Because of the severity of our client s injuries, we then filed a claim under his UM Coverage for the full policy limits of $100,000 which the UM carrier tendered.
