Civil Justice Myths: Reports from the Department of Justice

Palm Beach County, Florida – Attacks on the civil justice system are frequently made by corporations and members of big business; however, a study by the Department of Justice prove that “jackpot justice” and “runaway jury awards” are merely myths created by opponent of the civil justice system.

Statistics include:

  • Tort cases comprise only six percent of civil filings in state courts. That number has decreased by 21 percent between 1997 and 2006.
  • Tort actions account for less than one percent of all civil filings in federal courts
  • Manufacturing companies ranked “fear of litigation” as their lowest concern
  • The median legal expenses for individuals in the last year were far from exorbitant and ranged from $4,000 to $5,000
  • The median award in tort cases was $24,000
