Confidential Seven Figure Settlement in Multi-Vehicle Rear-End Crash for “Eggshell Plaintiff”

Attorney Keith R. Hedrick and Paralegal Joshua Cadrin recently settled a multi-vehicle rear-end collision claim for a confidential seven-figure Carton of Eggs and a broken Eggshell settlement on behalf of a client who was seriously injured. The crash occurred when our client, who was stopped with the flow of traffic, was struck from behind by a driver following too closely. Moments later, that same driver was hit from the rear by another vehicle, causing a second rear-end impact to our client. The force of these consecutive impacts resulted in significant injuries to our client’s neck and low back. Following the failure of conservative treatment and injection therapy, her pain persisted, and she ultimately required surgery to her lower back.

Importantly, our client was what the law refers to as an “eggshell plaintiff.” Under Florida Law, a defendant must take a plaintiff as they find them. This means that even if a person has pre-existing conditions or prior injuries, the at-fault parties are still fully responsible for any aggravation or worsening of those injuries caused by their negligence. In this case, while our client did have prior neck and back conditions – both of which required prior surgical intervention – and the crash substantially aggravated those issues.
