Barack Obama has issued a directive that “preemption of State law by executive departments and agencies should be undertaken only with full consideration of the legitimate prerogatives of the States and with sufficient legal basis for preemption.” Essentially, Pres. Obama has reversed a policy enacted by the Bush administration that allowed federal agencies to preempt state laws and regulations.

This new policy will protect states rights and the rights of individuals, especially as it relates to state product liability laws. State product liability laws should go hand-in-hand with similar federal laws, as these are the guidelines and regulations put in place to protect consumers and their families.
