Progressive Continues to Delay, Deny, and Force Litigation

Partner Scott Perry recently resolved another case with Progressive after it tried to do everything it could to avoid paying on our client’s case. On a clear-cut case, Progressive tried to avoid paying anything to our client – including blaming our client for the crash. It did not work!

Our client was less than a mile from her home, when she was turning left with a green turn arrow when an 18-year-old driving a sports sedan was speeding through the same intersection and failed to stop for a red light, striking our client’s SUV and then coming to rest a several hundred feet down the road. The distance the other driver traveled after the heavy impact showed the speed, well over the speed limit, that the inexperienced driver was traveling. Below you can see the damage from the crash.

Progressive, the at-fault driver’s carrier, ignored every demand and all of the evidence and claimed that our client was at fault. After multiple opportunities to re-evaluate its position on liability, Murray Guari Perry filed suit.

This caused Progressive to have a new litigation adjuster to review the file. The new adjuster admitted that he did not understand the position of the prior adjuster when confronted with the speeding and the running of the red light by the tortfeasor and tendered the policy limits. This was followed by a tender of the policy limits for the Underinsured Motorist Carrier a few days later. Progressive’s actions delayed the resolution of our client’s case for no purpose but to keep money in its pockets for longer, earning Progressive interest.
