Jason J. Guari, Esq., and Keith R. Hedrick, Esq., recently secured a $400,000 settlement for their client, Mr. S, a United States Army Vietnam War Veteran, in a bicyclist vs. motor vehicle crash.
In the summer of 2018, Mr. S – an extremely active individual in his mid-seventies – was riding his bicycle in the designated bicycle lane in Delray Beach, Florida. Unfortunately for Mr. S, he was in the right place at the wrong time, when a distracted driver failed to stop at a stop sign and pulled out directly into his path of travel. There was nothing Mr. S could do to avoid the crash and he was ultimately thrown off his bike, onto the ground, and came to rest under the negligent driver’s vehicle.
As a result of the crash, Mr. S sustained injuries to his head, neck, shoulders, knees, and chest. Despite his stoic nature, he immediately presented to the hospital where he was diagnosed with broken ribs, and injuries to this head, neck, shoulders, and knees. After conservative care failed to completely relieve his symptoms, Mr. S underwent an arthroscopic surgery to his knee and a rotator cuff repair surgery to his shoulder.
This crash unequivocally changed the life of Mr. S. Despite the success of the surgeries, he was no longer the same active and energetic person he was before hand. In many ways, this crash robbed Mr. S of the ability to enjoy his golden years of retirement.
Through the hard work of Mr. Guari and Mr. Hedrick, the negligent driver’s insurance company agreed to a pre-suit mediation. At mediation, both sides reached a settlement agreement for $400,000, and Mr. S and his family were finally able to start to put this terrible situation behind them.
