WEST PALM BEACH, Fla.- On the early evening of April 15, 2006, Daniela and John Ferriter came to The Tuscany of Palm Beach to have dinner with family and friends. Before dinner Daniela and several guests went down to the beach to admire the ocean view. Daniela was standing on the wooden platform of the beach stairs when the railing suddenly gave way plunging her more than 15 feet onto a hard-packed sand dune below. Daniela broke her back in five places.
“The staircase in question was severely damaged after hurricanes Jeanne and Frances in September of 2004 and posed a serious safety hazard to residents and guests,” stated family attorney Scott Murray of West Palm Beach law firm, Murray Guari. “Rather than obtain a local, experienced marine contractor, The Tuscany’s Board of Directors agreed to hire the son-in-law of the Board President who was an unlicensed, unbonded and uninsured handyman from Vermont. No permits were applied for or granted.”
Back in 2001 these same beach stairs were replaced. Then The Tuscany retained an experienced, licensed and insured marine contractor who prepared drawings and pulled appropriate permits.
“Daniela suffered catastrophic injuries as a result of The Tuscany’s negligence and complete disregard for safety, added Murray,” “She is still recovering from a complicated double laminectomy and L2-L5 fusion surgery in December.”
The Ferriter family has filed a suit against The Tuscany of Palm Beach Condominium Association, Inc. in the Circuit Court of the 15th Judicial Circuit for Palm Beach County, Florida.
